A Framingham firefighter is accused of repeatedly hitting his girlfriend in the head with a cellphone on Sunday in Ashland and shoving her brother, authorities said.

Police arrested Henry Funes, 37, at his 193 Winthrop St., Framingham, home after the 1:45 a.m. assault at his girlfriend's New Castle Road home, according to an Ashland Police report filed in Framingham District Court on Monday.

Funes' girlfriend told police she had sent a text message to Funes to break up with him because she thought he was cheating.

According to police, Funes arrived at her house and they argued. The woman's brother tried to break up the argument, and after he thought things calmed down, he went back to bed.

However, according to court records, that's when Funes turned violent.

"Henry took (the victim's) iPhone 6 and used it to strike her in the head several times," according to the report.

The victim was left with a cut and a large bump over her right eye, according to the report. The phone was also bent.

Funes left the home with the victim's broken phone and her brother went outside to get it from him. Funes' shoved the man before throwing the phone onto the front porch, according to the report.

Police charged Funes with two counts of assault and battery and one count of assault and battery with a dangerous weapon (cellphone) and malicious destruction of property.

The woman obtained a restraining order against Funes in court on Monday banning him from contacting or going near her.

Judge Lynn Coffin Brendemuehl released Funes without bail, but ordered him to have no contact with either his girlfriend or her brother. Funes is due back in court on Feb. 8 for a pretrial conference.

The status of Funes job with the Framingham Fire Department is not known. Framingham Fire Chief Gary Daugherty said Monday afternoon he had not heard about Funes' arrest. Typically, if a firefighter is arrested he or she is placed on administrative leave until the department conducts an investigation, Daugherty said.


Henry Funes is a 1996 graduate of Keefe Tech High School

If the iPhone6 was destroyed, that's malicious destruction of over $500.

Henry Funes is probably still employed by the Framingham Fire Department and probably on administrative leave, accumulating pay and vacation time at the taxpayers expense.

This was at least his second arrest for domestic violence.

FRAMINGHAM - A Framingham man was arrested yesterday at 1:57 a.m. after a domestic dispute, police said.

Henry Funes, 31, of 193 Winthrop St., was charged with assault and battery and malicious mischief causing more than $250 worth of damage, police said.


I'm guessing the chunky Lolitta on his right (your left) is his favorite.
