We are appealing our case May17, 2010 on the reasons below:
On major violations:
6.1.A.9 Failure to completely and truthfully execute the FPAC User
Agreement Contact Form
Our answer: Not true
6.1.A.10 Abuse or harassment of staff or other members
Our Answer. Not true
6.1.A.12 Commercial of profit-making use of FPAC facilities or equipment
Our Answer. Not true
6.1.A.15 Falsifying forms or documents
Our Answer: Not true
6.1.A.16 Other illegal activities.
Absurd statement void of facts or description:
Our Answer: Not true
6.1.A.17 A substantial pattern of multiple violations
Absurd statement void of facts or description
Our answer: Not true
6.1.A.18 Any violation of law which poses a risk of legal culpability or
liability for FPAC
Absurd statement void of facts or description
Our answer: Not true
A year suspension based on frivolous unfounded accusations, in this case,
three accusations placed as MAJOR Violations which are void of FACTS or
description, A 16-18, do not make for a legitimate complaint.
Even if ALL the Major and Minor accusations were true we were NEVER given
the opportunity to fix the problems according to the Policy and Procedures
manual March 2010. In other words, those accusations would be our FIRST
offence.
Our last two shows CCFIILE # 253 and Weekly Show # 115 had NO complaints
proving that we complied with the wishes of the FPAC board of directors and
its Policies and Procedures.
The sanctions given to us are excessive in view of the facts that we have
not received any previous sanctions, discipline or meetings to deal with
the previous violations.
These are the basis for our appeal.

To the BOD of FPAC-TV
This is the second time this letter has been sent out the first was
June 2, 2010
.
Why you say it has to be submitted again is beyond me.
So for a second time.....
My brother and I feel that the decision to suspend us is not based on
the true presentation of facts and a little severe for the circumstances.
I our opinion...
The major violations were not as "major" as presented and we will show
the facts.
Abuse and Harassment No!
Falsifying documents... No!
Other illegal activities. No!
Etc etc....NO!
The Sanction to take us off the air for a year is a little harsh wouldn't
you say considering that other lesser sanctions could of been done
(week suspension) if you really wanted to work with us.
The purpose of any complaint is to help the violator to comply with the
rules, NOT to kick the person out of a program. We tried our best to be
compliant, and will show evidence of this.
As far as I can see we fixed most of the complaints yet you didn't seem
to take all that in account. Watch our latest Weekly Show 115 and see
if we are not compliant.
The real issue with FPAC-TV is not our violations per se but our content,
pure and simple, which all comes down to FREE SPEECH issues.
Another rather harsh sanction is saying we can't even collaborate with anyone
else to help them to produce programming that will air on their station.
So now our productions skills our not even wanted to help others???
Not reasonable in my book.
So with all the above we base our appeal.
